These Terms of Service ("Terms") govern your use of services provided by GuavaHost ("GuavaHost", "we", "our", or "us"), an Australian-based game server hosting provider operating internationally.

By purchasing or using our services, you agree to be legally bound by these Terms.

If you do not agree with these Terms, you must not use our services.

2. Services Provided

GuavaHost provides:

  • Game server hosting
  • Add-ons and digital services

All services are provided on a subscription basis unless otherwise stated.

We reserve the right to modify, suspend, or discontinue any service at any time.

3. Eligibility

By using our services, you confirm that:

  • You are at least 18 years old, or
  • You have parental/guardian consent
  • You are legally able to enter into binding contracts

4. Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity occurring under your account
  • Providing accurate billing information

We may suspend or terminate accounts that provide false information or violate these Terms.

5. Subscription & Billing

5.1 Recurring Subscription

All services are recurring subscription services.

By purchasing, you authorize GuavaHost to automatically charge your selected payment method at the agreed billing interval (monthly or otherwise).

Your subscription will continue to renew automatically unless you cancel it.

5.2 Cancellation

You must notify us if you wish to cancel your subscription.

Cancellation requests must be submitted before your next billing cycle.

Failure to cancel does not constitute grounds for refund.

6. Refund Policy

6.1 48-Hour Refund Window

We offer a refund within the first 48 hours from the time of initial purchase.

Refund requests must be submitted in writing within this period.

6.2 After 48 Hours

After 48 hours:

  • Refunds are not guaranteed.
  • Refund requests are reviewed on a case-by-case basis.
  • Approval is at GuavaHost's sole discretion.

6.3 Non-Refundable Circumstances

Refunds will not be provided for:

  • Failure to cancel recurring subscriptions
  • Violations of these Terms
  • Service suspension due to abuse
  • Misconfiguration by the customer
  • Third-party software incompatibility

Nothing in this section excludes rights under applicable consumer protection laws, including Australian Consumer Law where applicable.

7. Acceptable Use Policy

You agree not to use our services for:

  • Illegal activities
  • Copyright infringement
  • Hosting malicious content
  • Distributed denial-of-service (DDoS) attacks
  • Harassment, hate speech, or abusive content
  • Cryptocurrency mining (unless explicitly allowed)
  • Resource abuse affecting other customers

We reserve the right to suspend or terminate services without notice for violations.

8. Resource Usage

GuavaHost provides allocated resources based on the purchased plan.

Excessive or abusive resource usage that impacts system stability may result in:

  • Throttling
  • Suspension
  • Termination

9. Service Availability

We aim for high uptime but do not guarantee uninterrupted service.

We are not liable for:

  • Network outages
  • Datacenter failures
  • Force majeure events
  • Third-party provider failures
  • Internet backbone issues

Scheduled maintenance may occur with or without notice.

10. Data & Backups

While we may provide backup functionality, customers are solely responsible for:

  • Maintaining their own backups
  • Ensuring data integrity

GuavaHost is not liable for data loss.

11. Limitation of Liability

To the maximum extent permitted by law:

GuavaHost shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits
  • Loss of data
  • Business interruption

Our total liability shall not exceed the amount paid for services in the previous 30 days.

Nothing in these Terms limits rights under mandatory consumer laws.

12. Chargebacks & Payment Disputes

Filing a chargeback without first contacting us may result in:

  • Immediate account suspension
  • Permanent service termination
  • Additional recovery fees

We encourage customers to contact support before initiating disputes.

13. Intellectual Property

All trademarks, logos, and materials belonging to GuavaHost remain our intellectual property.

You may not copy, resell, or redistribute our services without written permission.

14. Termination

We reserve the right to suspend or terminate services for:

  • Breach of Terms
  • Non-payment
  • Illegal use
  • Abuse of staff or systems

Termination does not entitle you to a refund unless required by law.

15. Governing Law

These Terms are governed by the laws of Australia.

Where required by applicable law, consumer rights under local jurisdictions may apply to international customers.

Disputes shall be resolved in the courts of the relevant Australian state in which GuavaHost operates.

Service Level Agreement

Effective Date: 22 February 2026

1. Purpose

This Service Level Agreement (SLA) defines the level of service provided by GuavaHost to customers using our game server hosting services. It outlines GuavaHost's responsibilities, performance standards, and customer expectations.

2. Scope

This SLA applies to all GuavaHost-managed game servers hosted in Australia, including but not limited to:

  • Minecraft
  • Valheim
  • Rust

This SLA covers server uptime, support, and incident management.

3. Service Availability & Uptime

GuavaHost strives to maintain a monthly uptime of 99.9% for all game servers.

Uptime is measured as total time the service is available, excluding downtime caused by:

  • Customer misconfiguration
  • DDoS attacks or malicious activity
  • Third-party infrastructure or hardware maintenance beyond GuavaHost's control
  • Force majeure events (natural disasters, power outages, ISP issues)

Downtime caused by these factors does not count against uptime guarantees.

4. Maintenance & Notifications

Some server downtime may occur due to maintenance performed by third-party infrastructure or hardware providers.

GuavaHost does not control the physical hardware and may not be able to provide advance notice.

GuavaHost will notify affected customers as soon as possible when we are informed of scheduled maintenance or outages.

Downtime caused by third-party maintenance does not count toward SLA credits.

5. Support

GuavaHost provides support for server issues through:

  • Email: management@guavahost.com
  • Live chat: via the GuavaHost dashboard
  • Ticket system: accessible through your customer account

Support is available 24/7, but response times may vary if the issue originates from third-party infrastructure.

6. Customer Responsibilities

Customers are responsible for:

  • Maintaining secure passwords for their server and control panel
  • Keeping server files and mods within GuavaHost guidelines
  • Using the service in compliance with all applicable laws
  • Regularly backing up data; GuavaHost provides optional backup services, but the customer retains responsibility for their data

7. Incident Management & SLA Credits

If server uptime falls below 99.9% due to GuavaHost faults, customers may request an SLA credit.

SLA credit calculation:

SLA Credit (%) = (Downtime minutes / Total minutes in month) × 100

Maximum SLA credit per month: 50% of monthly hosting fee

Credits are issued only upon customer request and after verification by GuavaHost.

Downtime caused by third-party infrastructure or hardware is not eligible for SLA credits.

8. Security & Data Protection

GuavaHost implements industry-standard security measures, including firewalls and DDoS protection.

Customer data is stored securely and handled according to Australian data protection laws.

GuavaHost cannot guarantee complete protection against cyber threats and is not liable for data loss caused by customer mismanagement or third-party attacks.

9. Exclusions

This SLA does not cover:

  • Downtime caused by customer misconfiguration
  • Third-party software, mods, or plugin issues
  • ISP/network issues outside GuavaHost's control
  • Scheduled maintenance by third-party infrastructure providers beyond GuavaHost's control

10. Termination & Modification

GuavaHost may modify this SLA with 30 days' notice.

Continuation of service after the notice period constitutes acceptance of the updated SLA.

Termination of hosting service terminates SLA obligations.

11. Limitation of Liability

GuavaHost's total liability under this SLA is limited to SLA credits as defined in Section 7.

GuavaHost is not responsible for any indirect, consequential, or incidental losses, including lost gameplay, revenue, or data.
